Entwicklungs- und Nutzungstrends im Bereich der digitalen Medien und damit verbundene Herausforderungen für den Jugendmedienschutz

Teilbericht 1:
Traditionelle Jugendschutzregulierungen haben in einer digitalisierten und global vernetzten Medienwelt an Effektivität verloren. Der Expertenbericht beleuchtet aktuelle technologische Entwicklungs- und Nutzungstrends, die im Zusammenhang mit dem Jugendmedienschutz stehen. Dafür wurden von der ZHAW Zürcher Hochschule für Angewandte Wissenschaften umfassende Literaturrecherchen durchgeführt sowie Expertinnen und Experten aus der Technologiebranche (Swisscom, Google und Microsoft) befragt. Als zentrale Trends konnten „Mobile“ und „Cloud“ identifiziert werden. Mobile bezeichnet die rasant zunehmende Bedeutung von mobilen Geräten und den mobilen Internetzugang, der zeit- und ortsunabhängigen Zugriff auf Daten ermöglicht. Mit Cloud ist die Datenlagerung in externen Rechenzentren gemeint. Durch die rasante Zunahme mobiler Geräte sind in Familienhaushalten immer mehr webfähige Multifunktionsgeräte vorhanden, die durch intuitive Bedienung von immer jüngeren Kindern genutzt werden. Durch den mobilen Internetzugang wird die Kontrollfunktion der Eltern ausgehebelt. Für den Jugendmedienschutz bedeutet dies, dass immer jüngere Kinder mit nicht altersgerechten Inhalten konfrontiert oder online belästigt werden können. Die Konvergenz von Geräten und Inhalten führt dazu, dass der Jugendmedienschutz mit Fokus auf einzelne Trägermedien (z.B. CDs oder DVDs), zunehmend zu kurz greift, weil viele Medieninhalte online verfügbar sind und auf ausländischen Servern liegen. Die Schnittstellen zum Internet werden mit Apps, Geo-Daten und dem „Internet der Dinge“ immer unsichtbarer. Datensicherheit, Datenschutz sowie internationale Kooperation sind zentrale Herausforderungen eines modernen Jugendmedienschutzes.


Teilbericht 2:
Die rasante Entwicklung der Informations- und Kommunikationstechnik (technische Konvergenz) verändert die medialen Nutzungsgewohnheiten von Kindern und Jugendlichen. Neben neuen Nutzungschancen ergeben sich neue Gefährdungen, welche die Jugendschutzregulierung vor teils fundamentale Herausforderungen stellen. Die im Auftrag des BSV erfolgte Studie gibt einen Überblick über die beobachtbaren und prognostizierbaren Veränderungen in der Mediennutzung der Kinder und Jugendlichen, systematisiert die bestehenden Problemlagen und leitet aus einer steuerungs­wissenschaftlichen Perspektive die drängendsten regulatorischen Herausforderungen ab.
Im Hinblick auf Angebotsformen und Mediennutzung wird deutlich, dass das breite Angebot an Medien- und Kommunikationsdiensten für Kinder und Jugendliche vielfältige Nutzungs- und auch Beteiligungsmöglichkeiten anbietet, die neue Chancen im Bereich der Kommunikation, Information, Unterhaltung und Bildung eröffnen, aber auch neue Gefährdungen mit sich bringen. Problemlagen entstehen vor allem dort, wo traditioneller Jugendschutz noch ausschließlich auf die passive Rezeption massenmedialer Inhalte abzielt, die Minderjährigen aber durch neue interaktive und kommunikative Nutzungsformen zunehmend über den Rezipienten hinausgehende neue Rollen übernehmen: In neuen Medienumgebungen sind sie (auch) Marktteilnehmer, Teilnehmer an individuellen Kommunikationsprozessen mit Bekannten und Unbekannten, und sie sind selbst Akteure, die ungeeignete oder verletzende Inhalte produzieren können.
Die steuerungswissenschaftlich geleitete Analyse kommt zu dem Ergebnis, dass rein medieninhaltsbezogene Schutzkonzepte nicht mehr ausreichen – Jugendschutz muss den Risikodimensionen und jeweiligen Altersgruppen entsprechende, ausdifferenzierte Steuerungsansätze wählen. Angesichts der Vielfalt der Regelungsadressaten und Akteurskonstellationen sowie grenzüberschreitender Anbieter- und Angebotsstrukturen erscheinen zudem Ansätze aussichtsreich, die auf eine geteilte Gewährleistungsverantwortung zwischen Staat, Wirtschaft und internationalen Stellen setzen. Zuletzt muss Jugendschutz neben netzwerkgerechten, digitalen Schutzinstrumenten auch in Zukunft Steuerungsansätze bieten, die Eltern in der Übernahme ihrer Erziehungsverantwortung bestärken und ihnen alltagstaugliche Hilfsmittel in die Hand geben können.

Development and usage trends in the area of digital media and associated challenges in protecting young people from the media

Substudy report 1:
Traditional youth protection regulations have become less effective in a digital, globally networked media world. The expert report highlights current technological development and usage trends related to the protection of minors against harmful media. In the process, Zurich University of Applied Sciences (ZHAW) carried out an extensive study of the literature and questioned experts from the technology sector (Swisscom, Google and Microsoft). "Mobile" and "Cloud" were identified as key trends. "Mobile" describes the rapidly increasing importance of mobile devices and mobile Internet access, whereby it is possible to access data from anywhere at any time. "Cloud" refers to the storage of data in external computing centres. The swift rise in mobile devices means that households now have ever more Internet-enabled multi-functional devices available which, due to their intuitive interfaces, can be operated by younger and younger children. With mobile Internet access, parents have less control. For youth protection services dealing with the media, this means that ever-younger children can find themselves faced with unsuitable content for their age, or fall victim to online harassment. The convergence of devices and content means that youth protection measures focusing on individual recording media (e.g. CDs or DVDs) are becoming increasingly ineffective, as a great deal of media content is now available online and stored on foreign servers. The interfaces to the Internet are becoming less and less visible with apps, geo-data and the "Internet of Things". The main challenges facing modern youth protection regulators dealing with the media are data security, data protection and international cooperation. 

Substudy report 2:
The rapid progress in information and communication technologies (technical convergence) is changing the way that children and young people use the media. In addition to new opportunities, this also brings with it new dangers, some of which pose fundamental challenges to youth protection regulators. The study carried out on behalf of the Federal Social Insurance Office (BSV) provides an overview of the observed and foreseeable changes in media usage by children and young people, systematically identifies the current problems and derives the most pressing regulatory challenges from a governance ­ perspective.
With respect to the types of offer and media usage, it is clear that the wide range of media and communication services aimed at children and young people open up many different ways of using and participating in them. While these create new opportunities in the areas of communication, information, entertainment and education, they also bring with them new dangers. Problems particularly arise in areas where traditional youth protection measures still focus on the passive reception of mass media content. However, new interactive and communicative usage forms mean that minors are increasingly assuming new roles that go beyond mere reception. In the new media environments, they (also) act as market participants, participate in individual communication processes with people they may or may not know, and are themselves actors with the potential to produce unsuitable or harmful content.
The governance-based analysis came to the conclusion that protection concepts focusing on media content alone are no longer sufficient, and that youth protection services must choose different governance approaches according to the scale of the risks and age groups involved. Given the wide range of regulation addressees, groups of actors and cross-border provider and offering structures, the approaches that appear promising are those calling for the government, business community and international bodies to share responsibility. Finally, in addition to digital protection instruments suitable for networks, in the future, youth protection services also need to offer control approaches that help parents bring up their children responsibly and provide them with tools they can use in their day-to-day lives.

Evolutions et tendances d’utilisation dans le domaine des médias numériques et défis qui en résultent pour la protection de la jeunesse face aux médias

Dans l’univers médiatique numérique et mondialisé que nous connaissons aujourd’hui, la protection de la jeunesse, sous sa forme traditionnelle, a perdu de son efficacité. Le rapport de recherche met en lumière les évolutions technologiques et les tendances d’utilisation actuelles en rapport avec la protection de la jeunesse face aux médias. A cette fin, la Haute école zurichoise de sciences appliquées (ZHAW) a effectué des recherches bibliographiques poussées et mené des entretiens avec des experts du secteur de la technologie (Swisscom, Google et Microsoft). Les principales tendances qui s’en dégagent tiennent en deux mots : « mobile » et « nuage ». « Mobile » désigne les appareils et l’accès Internet qui permettent d’accéder aux données en tout temps et en tout lieu. Quant au « nuage », il désigne le stockage des données sur des centres de calcul externes. Avec la croissance exponentielle du nombre d’appareils mobiles, les familles possèdent toujours plus d’appareils multifonctions avec accès à Internet qui, grâce à leur interface intuitive, peuvent être utilisés par des enfants de plus en plus jeunes. L’accès mobile à Internet complique le contrôle parental. Pour la protection des jeunes face aux médias, cela signifie que des enfants de plus en plus jeunes risquent d’être confrontés à des contenus non adaptés à leur âge ou d’être harcelés en ligne. Avec la convergence des appareils et des contenus, la protection axée sur des supports individuels (par ex. CD ou DVD) ne suffit plus, parce que de nombreux contenus sont disponibles en ligne et stockés sur des serveurs étrangers. Par ailleurs, avec les applications, les géodonnées et l’« Internet des objets », les interfaces avec Internet sont de moins en moins visibles. La sécurité et la protection des données, ainsi que la coopération internationale sont les enjeux centraux d’une protection moderne des jeunes face aux médias.


Rapport partiel 2:
L’évolution très rapide des technologies de l’information et de la communication (convergence numérique) modifie les habitudes des enfants et des jeunes. Il en découle de nouvelles possibilités d’utilisation, mais également de nouvelles menaces, ce qui soulève des difficultés parfois sérieuses dans le domaine de la protection de la jeunesse. L’étude réalisée sur mandat de l’OFAS fournit une vue d’ensemble des évolutions observables et prévisibles en matière d’utilisation des médias par les enfants et les jeunes, pose la problématique qui en résulte et met en évidence les défis les plus urgents auxquels le cadre légal devra répondre.
Vu la diversité de l’offre en matière de médias et de communication, les enfants et les jeunes ont le choix entre de multiples formes d’utilisation et de participation, qui leur ouvrent de nouvelles opportunités en matière de communication, d’information, de divertissement et de formation, mais les exposent aussi à de nouveaux dangers. Les problèmes naissent surtout dans les domaines où la protection de la jeunesse reste axée sur la réception passive de contenus de masse, alors que les mineurs, via les nouvelles formes d’interaction et de communication, sont désormais souvent bien plus que de simples récepteurs : dans le nouvel environnement médiatique, ils sont aussi agents économiques, interlocuteurs dans des communications personnelles avec des individus connus ou inconnus d’eux, et acteurs pouvant produire eux-mêmes des contenus inappropriés ou blessants.
L’analyse basée sur la nouvelle gestion publique montre que les stratégies de prévention tenant compte uniquement du contenu véhiculé par les médias ne suffisent plus : la protection de la jeunesse doit opter pour des modes de régulation différenciés correspondant aux différents types de risques et aux différents groupes d’âge. Vu la multiplicité des acteurs impliqués et des destinataires auxquels s’adresse la réglementation, mais aussi étant donné le caractère international des offres et des fournisseurs, un partage des responsabilités entre l’Etat, l’économie et les organes internationaux semble judicieux. Enfin, la protection de la jeunesse devra continuer à concilier les instruments de protection adaptés au réseau numérique avec des modes de régulation qui permettent aux parents de mieux assumer leur responsabilité éducative et qui leur fournissent les moyens de le faire au quotidien.

Tendenze di sviluppo e di utilizzo nel settore di media digitali e conseguenti sfide per la protezione della gioventù dai rischi dei media

Nel mondo digitalizzato e globale dei media, le tradizionali misure di regolamentazione a protezione della gioventù hanno perso la loro efficacia. Il rapporto peritale analizza le attuali tendenze di sviluppo tecnologico e di utilizzo rilevanti per la protezione della gioventù dai rischi dei media. Lo studio, realizzato dall’Università di Scienze applicate di Zurigo (ZHAW), si fonda su una vasta analisi della letteratura scientifica e su interviste condotte con esperti del settore tecnologico (Swisscom, Google e Microsoft). Le principali tendenze possono essere riassunte con i termini mobile e cloud (nuvola informatica). Mobile designa sia l’importanza dei dispositivi mobili, in rapida crescita, che l’accesso mobile a Internet, che permette di disporre di dati sempre e ovunque. Per cloud si intende lo stoccaggio di dati in centri informatici esterni. In seguito al rapidissimo aumento dei dispositivi mobili, le economie domestiche dispongono di un numero sempre maggiore di dispositivi multifunzionali con accesso alla rete, che grazie alla loro intuitività d’uso possono essere impiegati da bambini sempre più piccoli. L’accesso mobile a Internet pregiudica la funzione di controllo dei genitori. Sul piano della protezione della gioventù, ciò significa che bambini sempre più piccoli possono trovarsi confrontati a contenuti non adatti alla loro età o cadere vittime di molestie in rete. La convergenza dei dispositivi e dei contenuti mediali fa sì che la protezione dei giovani incentrata su singoli supporti (p. es. CD o DVD) è sempre più inefficace, poiché molti contenuti sono disponibili online o memorizzati su server esteri. Le applicazioni mobili (app), i dati di geolocalizzazione e il cosiddetto “Internet delle cose” rendono sempre più invisibile le interfacce con la rete.  Gli elementi centrali di una protezione dei giovani dai rischi dei media al passo con i tempi sono pertanto la sicurezza e la protezione dei dati nonché la cooperazione internazionale.

Rapporto parziale 2:
Il rapidissimo sviluppo tecnologico nel campo dell’informazione e della comunicazione (convergenza tecnologica) fa sì che bambini e giovani cambino le loro abitudini nell’utilizzazione dei media. Per gli utenti, i progressi compiuti in questo settore hanno creato sì nuove opportunità, ma anche nuovi pericoli, che pongono problemi fondamentali per quanto concerne la regolamentazione nell’ambito della protezione della gioventù. Lo studio realizzato su incarico dell’Ufficio federale delle assicurazioni sociali, fornisce una panoramica dei cambiamenti osservati e prevedibili nell’impiego dei media da parte di bambini e giovani, classifica i problemi esistenti e mette in evidenza, da un punto di vista scientifico, le principali sfide da affrontare sul piano normativo.
Dall’analisi emerge chiaramente che l’ampio ventaglio di media e servizi di comunicazione disponibili offre a bambini e giovani molteplici possibilità di utilizzazione e di partecipazione, che aprono sì nuove opportunità nei settori della comunicazione, dell’informazione, dello svago e dell’istruzione, ma celano anche nuovi pericoli. I problemi insorgono essenzialmente laddove la protezione della gioventù continua a focalizzarsi esclusivamente sulla ricezione passiva di contenuti mediali di massa, cui i minori possono ormai accedere attraverso nuove forme di utilizzazione interattive e comunicative, assumendo sempre più spesso ruoli che vanno al di là di quello di semplici riceventi. Nel nuovo paesaggio mediale essi intervengono anche come attori del mercato, come partecipanti a processi di comunicazione individuali (talvolta con persone che nemmeno conoscono) e come produttori di contenuti che possono rivelarsi inappropriati o offensivi.
Dall’analisi emerge che le misure e le strategie incentrate esclusivamente sui contenuti mediali non bastano più a garantire la protezione dei minori. Per tutelare la gioventù dai rischi dei media è necessario differenziare gli approcci di regolamentazione in funzione del tipo di rischio e della fascia di età degli utenti. Se si considerano la molteplicità di destinatari e di attori nonché il fatto che le strutture dei fornitori di prestazioni e dell’offerta oltrepassano le frontiere nazionali, per avere maggiori possibilità di successo bisogna puntare su metodi in cui la responsabilità per gli interventi è ripartita tra Stato, economia e organi internazionali. Infine, per tutelare la gioventù, oltre a strumenti di protezione adeguati alla rete numerica, bisognerà continuare ad offrire approcci di regolamentazione che permettano ai genitori di assumere in modo più efficace, nella vita quotidiana, le loro responsabilità educative offrendo loro strumenti adeguati.
